SOA for Panel of Receivers

The Office of Fair Trading (OFT) within the Department of Justice and Attorney-General (DJAG) is seeking to establish a Standing Offer Arrangement (SOA) for the provision of professional services as receivers over trust property as provided for under the Agents Financial Administration Act 2014 (AFAA). The AFAA requires agents regulated under the Debt Collectors (Field Agents and Collection Agents) Act 2014, the Motor Dealers and Chattel Auctioneers Act 2014 and the Property Occupations Act 2014 to open and operate trust accounts if the agent holds monies on behalf of other parties. Circumstances arise where it is necessary for the OFT to appoint a receiver over trust property to take possession, manage, receive claims, identify who has a right to it, distribute it and identify defalcations in accordance with AFAA. The receiver reports to the chief executive DJAG.

The OFT has issued this Invitation to Offer to establish an SOA for the provision of receivership services throughout Queensland for a five year period. It is proposed to engage up to 10 suppliers who meet the evaluation criteria.
