Description

The National Electricity Rules (NER) and National Gas Rules (NGR) each create an alternative dispute resolution framework for the non-litigious management of disputes between energy market participants, and between energy market participants and the Australian Energy Market Operator (AEMO). These frameworks are administered by a Dispute Resolution Adviser (Adviser). The NER provide that the AER must appoint a Dispute Resolution Adviser on such terms and conditions as the AER may determine.The NGR provide that the Adviser will be appointed on terms and conditions determined by the AER.Over an initial period of three years from 1 July 2016 to 30 June 2019 the contractor will be required to perform all the functions of the Adviser specified in the National Electricity Law and Rules and National Gas Law and Rules (the national energy laws) as amended from time to time.Two options to extend the contract by fixed periods of 12 months (to a total of five years) will be included in the contract of appointment.
