Western Australia Police Force - Capel Police Station - Construction CONFIDENTIALITY OF TENDER DOCUMENTS The nature of these tender documents is such that all persons shall treat all aspects of the tender documents as confidential. In accordance with clause: 8.6 AS 2124 – 1992 CONFIDENTIAL INFORMATION “Drawings, specifications and other information, samples, models, patterns and the like, supplied by either the Contractor or the Principal and marked or otherwise identified as confidential, shall be regarded as confidential and shall not be disclosed to a third party except with the prior agreement of the other party to the Contract. If required in writing by a party, the other party shall enter into a separate agreement not to disclose to anyone else any confidential matter even after the issue of the Final Certificate pursuant to Clause 42.8 or the earlier termination of the Contract.” The Contractor (including tendering contractors, sub-contractors, suppliers, and the like parties engaged by the Contractor) shall ensure that the “Contract Confidentiality” form inserted at the appendix of these Preliminaries is signed by all parties engaged, or under consideration to be engaged, by the Contractor on the project in any manner (including to provide tenders, quotations, advice, goods, or the like) execute this form prior to their involvement. The Contractor (including at time of tender) shall provide copies of executed forms to the Superintendent on demand.
