CALL FOR EXPRESSION OF INTEREST FOR REPRESENTATION

The Director of Public Prosecutions (DPP) has charged two persons will alleged breaches of section 189 of the Criminal Law Consolidation Act and section 229 of the Companies Code (SA). The Supreme Court of South Australia has ordered a stay of proceedings in the prosecution of these persons on the ground of the inability of each defendant to obtain legal representation. The duration of the trial has been estimated by the Supreme Court as being not less than six months. The Legal Services Commission of South Australia now invited members of the legal profession who are entitled to practise in South Australia and who regularly conduct trials of indictable offences in the Criminal courts to submit Expressions of Interest for the representation of either defendant at the trial in the Supreme Court of the charges. Expressions of Interest will be evaluate by an Evaluation Panel against the criteria of: a) demonstrated competence and experience in the conduct of trial of indictable offences in the criminal courts; b) the fees sought by each party who expresses an interest in being selected to proceed as an Offeror; and c) any other matter which the Evaluation Panel considers to be relevant to select suitably qualified legal practitioners to represent the defendants. Following the evaluation of the Expression of Interest, the panel will select the parties who are to be invited to submit formal offers. Offerors will be paid a fee to consider the material constituting the case against the defendants, to confer will a defendant and the prosecution, and to prepare and submit an Offer to represent either of the defendants.
